TERMS AND CONDITIONS

 

Please take the time to read all the terms below carefully. 

 

1. THE AGREEMENT

All bookings are made with YAMA MOVEMENT 

By booking a retreat with us you acknowledge you have read and accepted the Terms and Conditions as set out above.

Please take the time to read and understand the terms and conditions of travel set out below prior to confirming your reservation with us. 

YAMA MOVEMENT also recommends you read and understand the specific health and fitness requirements for the retreat you intend to undertake.

In signing this agreement you acknowledge and agree that the activities undertaken as part of this tour are physically strenuous in nature and it is advised that participants are of a reasonable level of physical fitness. 

In signing this agreement you are agreeing that YAMA MOVEMENT is indemnified against any injury arising from the tour and agree to follow all reasonable directions and safety guidelines as given by the tour guide.

 By purchasing any of the following, you are agreeing to all terms and conditions:

Group classes

Workshops

 

 

2. VALIDITY

All prices are in Australian Dollars (AUD) and include GST. All prices and conditions are subject to change without notice.

 

 

3. THINGS YOU SHOULD KNOW

 

Retreats:

Some but not all retreats, offer are active participation based. We rely on the goodwill and cooperation of all passengers to make them a success. This includes your assistance in the preparation of meals, washing up, gathering firewood and loading/unloading of the vehicle.

It is expected that all participants will abide by reasonable directions given by their guide and will contribute to all logistical activities as asked.

It is expected that all participants will be of a good temper and will conduct themselves with respect and courtesy to guides and other tour participants.

YAMA MOVEMENT has a zero-tolerance policy for antisocial, aggressive and unsafe behaviour and reserves the right to cancel participants retreat without refund in the event of any behaviours not in accordance with the expectations as outlined above. 

 

Luggage:

Trip dependant - Due to space restriction -  please limit your luggage to 1 x soft bag of under 15kg.

If unsure, or you otherwise have any questions in respect of luggage, please feel free to contact us.

 

 

Note: Passengers are welcome to bring their own beverages if they wish, however, YAMA MOVEMENT strongly advises all participants to observe responsible drinking practices.

Additionally, YAMA MOVEMENT has a zero-tolerance policy for any consumption of Alcohol or Drugs as a part of our retreats and our advisors reserve the right to not allow any participants to engage in physical activities if they appear intoxicated, have poor coordination, or observe any other behaviours which are indicative of a safety hazard. 

 

 

4. PAYMENT POLICY

25% deposit is required at the time of booking. The remaining balance is due no later than 30 days prior to departure. 

All bookings made less than 30 days prior to departure must be paid for in full at the time of booking. 

All credit card payments (Visa and MasterCard) incur a 2% Merchant Levy surcharge.

This surcharge is subject to change without notice. 

 

 

5. CANCELLATION BY YOU

 

Please note that on all refunds there will be a $100 administrative fee deducted.

 

If cancelling 90 days or more prior to retreat or tour start date: Any payment made will be refunded upon request. 

 

If cancelling within 89-30 days of departure: Any payment made other than the non-refundable deposit will be refunded upon request. here will be a $100 administrative fee deducted.

 

Within 15-30 days of departure:  50% of the total price

Within 14 days: 100% of the total price

 

It is highly recommended that you seek travel insurance at the time of booking with YAMA, to ensure you are protected from any change in circumstances such as flight delays or cancellations, health impairments, acts of terrorism, work emergencies etc. 

 

YAMA MOVEMENTS accepts no liability for any injuries, damaged or lost property, or other issues that may arise whilst on our retreats. 

 

In signing the terms and conditions it is acknowledged that you agree that YAMA MOVEMENT bears no responsibility for any injury, loss or damaged property and you agree that you have been advised to seek relevant travel insurance from a licensed Insurance company or agency.

 

Due to the extensive planning and costs associated with touring, the following cancellation fees will apply in the event you should cancel for any reason. 

Please note, we accept no responsibility for lost, stolen or damaged property.

6. CANCELLATION BY YAMA MOVEMENT

At times YAMA MOVEMENT may have to cancel a tour or service. In the event we do have to cancel, every effort will be made to offer a suitable alternative. 

If no suitable alternative is able to be found or another equivalent tour is unavailable we will refund your tour price in full.  

Please take note, this is in extreme unforeseen circumstances. If the instructor falls ill, YAMA will have contingency plans in place to ensure the continued facilitation of all booked activities. 

 

Flights, accommodation and additional travel costs will NOT be reimbursed in the event of the YAMA movement cancelling the retreat. 

 

By signing this agreement you acknowledge that YAMA MOVEMENT is unable to assist in respect of travel and logistical arrangements with third parties and it is expected that all participants will find their own means of transportation to the designated meet area to begin their tour.

 

For this reason, it is crucial for all participants to seek their own travel insurance to prevent any financial loss that may be incurred in the event of any changes to travel

 

7. RECONFIRMING YOUR TOUR

To confirm your pick up point and time, please email:  elissa@yamamovement.com 1 week prior to departure

YAMA  will not be held responsible for any costs incurred due to changes in pick up details if reconfirmation is not made.

YAMA will not be held responsible for any delays resulting in a passenger missing tour inclusions or missing a scheduled flight.

 

 

8.PRIVACY POLICY

YAMA understands the importance of protecting your privacy. 

Any information we collect from you may be used for any purpose associated with delivering our tours and to provide you with relevant information.

 

9. HEALTH AND MEDICAL REQUIREMENTS

Due to the vast distances travelled on our tours, we may be many hours from medical facilities and as such we strongly urge you to disclose any medical concerns or conditions which you think may impact your ability to partake in activities.

It is the responsibility of you and your agent to declare any known medical condition(s) at the time of booking. 

YAMA reserves the right to request additional information and/or medical clearance (at your own expense) before confirming your reservation. This information is only to be used for the purposes of ensuring the safety of participants and will not be provided to any external third party unless on medical grounds and only as necessary.

Upon joining YAMA requires you to re-confirm any medical condition(s) to your guide and enough medication should be carried for the duration of your trip (cold storage is available).

A certain level of fitness is required for all safaris. To ensure that you enjoy your time on tour with us, you should be able to walk at least 10km, unaided, over rough, uneven ground (often in intense heat) and climb (or descend) steps or steep inclines without hindrance.

If you are unable to meet the required level, you must disclose this at the time of booking. In the interests of health and safety, YAMA reserves the right to refuse travel due to any medical conditions and/or fitness level which we deem necessary. YAMA  will not be liable for any additional expenses or cancellation fees imposed by ourselves or third parties incurred as a result of refusal to travel due to non-disclosure of medical information.

10. DIETARY REQUIREMENTS AND FOOD ALLERGIES

All of our menus are designed to be well balanced and healthy to provide the necessary sustenance for you to enjoy and participate in your tour. If you have any food allergies or specific dietary needs please contact us to discuss these requirements and we will advise you if they can be catered for.

Please note that without prior notification of any concerns with food, we cannot guarantee we can meet your specific dietary needs. 

 As we operate in remote parts of Australia, certain foods are not always readily available. 

Please note we may have to supplement our menus as regional supply dictates and therefore we cannot guarantee all ingredients contained in these alternatives. In these instances, we will advise you to provide your own supplementary food/ snacks depending on your specific requirements.

11. CHANGE OF ITINERARY

YAMA reserves the right to amend tour times, itineraries and fares for its products as circumstances, time of year and operational reasons occur. There will be no refunds in these circumstances nor for delays incurred due to mechanical failure, accident, weather or any other unforeseen circumstances. We cannot guarantee exact pick-up and drop-off times and will accept no responsibility in the event of cancellation fees from other connecting services.

Individual Aboriginal location visits cannot be guaranteed for cultural reasons and YAMA MOVEMENT strongly respects the traditions and rules of culturally important land. In the event of a location or host not being available alternative experiences of a similar nature will first be sought and failing this, refunds will be offered for this component only. No compensation will be considered for any additional driving or time lost due to such changes.

12. ACCEPTANCE OF RISK

Australia has many dangerous creatures, extreme weather conditions and often varying terrain. Camping, hiking and passing time outside may increase your personal risk of exposure to these dangers. Safety is our number one priority and all of our guides are highly trained to ensure passenger safety at all times. All passengers participating in our tours do so at their own risk and no responsibility can be accepted by YAMA for any loss, injury or accident. Passengers are responsible for any additional costs involved should such instances occur such as an ambulance. All passengers will be required to sign a liability waiver prior to departure.

The minimum age for children travelling on our safaris is 5 years at the time of travel however our demographic is from age 18-50. All passengers under the age of 18 must be accompanied by an adult or caregiver at all times. While all care is taken, the responsibility of children on tour rests entirely with the parent or caregiver. All passengers, including children, must wear shoes at all times, use sunblock and wear hats. Please note that we accept children of all ages travelling on our group and private charter tours

We strongly urge all participants to exercise common sense and good judgement when on tours and remind themselves that they are in nature which can be unpredictable.

13. LIMITATION OF LIABILITY

YAMA  works with the best operators available but takes no responsibility for any act of neglect by any operator whose services are used as part of your tour.

 Our suppliers make every effort to safeguard clients, and we cannot be held responsible for personal injury or sickness to any customer which is beyond our control. 

Passengers should note that adventure travel involves a higher than normal risk and a signed release may be required from all participants from a number of our activity providers.

 

14. AUTHORITY ON TOUR

Passengers must abide by the tour guides instructions and directions at all times, in particular with regard to actions and behaviour in National Park areas, Aboriginal communities, areas with elevated hazards or risks and emergency situations. Non-compliance with any directions from the tour guide or other authority may result in injury, death or the passengers being refused onward travel with no right to refund. 

15. PHOTOS AND MARKETING

You consent to us using images of you taken during the trip for advertising and other promotional purposes in any medium as we require. You agree that the use of these images is free and without any payable fees or compensation.

16. FEEDBACK

If you have any feedback regarding your trip please inform your tour guide at the time so they can try and rectify the issue. If after this time you still wish to provide us with some feedback, please put your concerns in writing and send them to us by emailing: elissa@yamamovement.com

17. APPLICABLE LAW

The laws of The Northern Territory, Australia govern these terms and conditions. Any disputes in connection with a tour or these terms and conditions must be initiated in the courts of The Northern Territory, Australia as the regional Jurisdiction.

 

 

  

GENERAL DISCLAIMERS:

 

1.Tours and Retreats

 

Every room may vary slightly in terms of size and amenities, however, all room types are equally priced. If you have specific requests or needs for your room, we will do our BEST to accommodate you, however, we cannot guarantee it can be done. ALL ROOMS ARE FIRST COME, FIRST SERVE- so the sooner you sign up, the more likely your needs will be fulfilled. If you do not have a roommate you will be paired with another guest who is not yet assigned a roommate. If you do not specify that you are booking for two guests during the check out we will assume you are a SINGLE GUEST booking a shared room.

 

 

2.General 

 

The total cost paid is for one space on the retreat which covers your room, food and transportation that is included (please read the inclusion list on the information page).

YAMA is not responsible for lost, stolen, or missing items.

YAMA is not responsible for airline cancellations, missed flights, or transportation issues prior to the retreat.

All reservations and bookings are first come first serve.

All rooms are shared unless you purchase a private room booking 

All prices are the same for each guest (with the exception of Early Bird Pricing)

A VALID PASSPORT IS REQUIRED if you are leaving your home country to attend the retreat. 

All deposits are non-refundable (it is important to take out your own travel insurance to avoid any financial loss)

You have until 61 days before the retreat to request any refund (The deposit is non-refundable even if requested prior to 61 days before the retreat start date).

Travel insurance is NOT included in the price of the retreat, and HIGHLY RECOMMENDED for ultimate protection

If you do not specify your roommate preferences we will assume you are open to any guest. 

You must pay your total retreat balance at least 3 days prior to the retreat start date by using our booking website (CASH IS NOT ACCEPTED UPON ARRIVAL).

You must sign and return a liability waiver BEFORE the first day of the retreat.

 

 

Roommate info

Please specify who your roommate will be for overnight retreats.

If you do not have a roommate you will be paired with another guest who is not yet assigned a roommate. 

If you have chosen a Single Bed you must specify a roommate who has already booked a Single Bed. 

If there are no single beds available and you are booking a Shared Bed, you will be sharing a bed with another guest of the retreat. Please put the word "female", "male", or "either", to give us an idea of who you would be comfortable sharing with. 

Please be aware that if you are booking a shared bed for two guests you must specify the quantity during checkout.

If you do not specify that you are booking for two guests during the check out we will assume you are a single guest booking a shared room.

 

 

 

3.Private, group classes and workshops

 

The waiver form must be signed and returned to YAMA before taking part in any private or group classes. 

 

If cancelling 24 hours or more prior to the start of the class, you incur no financial loss.

 

If cancelling 24 hours or less prior to the start of the class, you will incur a $20 cancellation fee. This will be deducted from the total amount that has been paid so far. If your class was not prepaid, you will be sent a $20 invoice. 

 

In the event of workshops being prepaid such as a 10 session children’s program, the participant would not be eligible for a refund due to there only being 10 sessions available. Once the program has been purchased the child is enrolled and there are no further reimbursements. 

 

If YAMA cancels a private, group class or workshop, all participants will receive a full refund.
